The Bauchi State High Court Number 10 has jailed a 32-year-old man, Usman Abubakar, a staff of Kirfi General Hospital, for killing a 60-year-old woman.
Abubakar was slammed with
three-count charge which include culpable homicide punishable with death,
attempt to commit homicide and criminal intimidation contrary to sections 221,
230 and 397 of the Penal Code Laws Cap 108 laws of Bauchi State Vol 3 (2007).
The state counsel, Mohammed Adamu,
had earlier told the court that the suspect was arrested by the village head of
Kirfi Kasa, Alhaji Umaru Mohammed, and taken to Kirfi Police Division in
BauchiState.
In his judgement, Justice Abdulkadir
Suleiman said from all the evidence before the court, there was no eyewitness
that saw the accused when he actually committing the act, except for the
confessional statement of the accused.
Justice Abdulkadir admited that the
prosecution succeeded in establishing that there was death of a human being on
the confessional statement of the accused, but the there are no tangible proof
that he commited the act, hence he cannot be punished with death under section
221 of the Penal Code.
